This Privacy Policy explains how FynIA ("FynIA," "we," "our," or "us") collects, uses, shares, and protects information when you use our AI-powered WhatsApp, Instagram, and Messenger automation platform (the "Service").

Capitalized terms not defined here have the meaning given in our Terms of Service.

1. Our Role

When you visit our website, create an account, or contact our team, FynIA acts as a data controller and determines how that information is used, as described in this Privacy Policy.

When you use FynIA to send and receive messages through your connected WhatsApp Business Account, Instagram, or Messenger, we process your customers' message content and metadata on your behalf, acting as a processor. You (the business using FynIA) are the controller of that data and are responsible for your own compliance obligations, including obtaining proper consent from your customers.

2. Data Shared With Meta and the WhatsApp Business Platform

To provide WhatsApp, Instagram, and Messenger automation, FynIA connects to Meta's APIs (the WhatsApp Business Platform, Instagram Graph API, and Messenger Platform). This means the phone numbers, message content, message templates, media, and delivery metadata exchanged through those channels are transmitted to and processed by Meta, in addition to FynIA.

Meta's own use of this data is governed by Meta's Privacy Policy and WhatsApp Business Data Processing Terms, not by this Privacy Policy. We encourage you and your customers to review Meta's policies directly. FynIA only requests the permissions and data scopes necessary to provide the messaging and automation features you enable.

3. Information We Collect

Account information: name, email address, company name, and password, or your name and email from an identity provider if you sign in with Google, GitHub, GitLab, or SSO.

Connected channel data: your WhatsApp Business Account ID, phone number, business profile information, and the message content, attachments, and metadata exchanged between you and your customers through connected channels.

Usage and device data: pages visited, features used, IP address, browser and device information, and log data, collected automatically when you use our website and Service.

Billing data: billing name, address, and payment card type processed through our payment provider. We do not store full card numbers.

4. How We Use Information

We use information to: provide, operate, and support the Service, including delivering messages and generating AI-assisted replies; authenticate your account and connected channels; monitor and improve the Service's performance, reliability, and security; communicate with you about your account, billing, and updates; and comply with legal obligations and enforce our Terms.

5. AI Processing of Message Content

When AI features are enabled, message content is sent to third-party AI providers acting as our sub-processors to generate suggested or automated replies. We do not permit these providers to use your data to train general-purpose AI models, and we do not use your message content for that purpose either.

You remain responsible for reviewing your automation settings and for any AI-generated message sent through your connected accounts.

6. How We Share Information

We do not sell your personal information. We share information with: Meta, to deliver messages through the WhatsApp Business Platform, Instagram, and Messenger, as described in Section 2; AI sub-processors, as described in Section 5; infrastructure, analytics, and payment providers who help us operate the Service under contractual confidentiality obligations; and legal or regulatory authorities where required by law.

7. Data Retention

We retain account information for as long as your account is active, plus a reasonable period afterward for backups and legal compliance. Message content and conversation history are retained for as long as needed to provide the Service, or until you delete them from your workspace, subject to any retention period required by law.

8. Data Security

We use industry-standard safeguards, including encryption in transit and at rest, access controls, and monitoring, to protect information. No system is completely secure; you are responsible for keeping your account credentials confidential.

9. Your Rights and Choices

Depending on your location, you may have the right to access, correct, delete, or export your personal information, restrict or object to certain processing, and withdraw consent where processing is based on consent. This includes rights available under the GDPR, the California Consumer Privacy Act, and similar laws in other jurisdictions.

10. Cookies

We use essential cookies for authentication and session management, and optional analytics cookies to understand how our website and Service are used. You can manage cookie preferences through your browser settings.

11. International Data Transfers

Your information may be processed in countries other than your own, including by Meta and our other service providers. Where required, we use appropriate safeguards, such as standard contractual clauses, to protect information transferred internationally.

12. Children's Privacy

The Service is not directed to individuals under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect.
